What is Action for Negative Declaration?
An action brought for the court to establish that no debt is owed.
It can be brought before or after enforcement proceedings. Where it is brought afterwards the proceedings do not stop automatically; an order staying enforcement may be obtained against security. If payment has been made, it becomes an action for restitution.
