How does the meeting work?

New development and property files along the northern axis

The new settlement areas along the Göktürk and Kemerburgaz corridor and the older building stock in Alibeyköy and Rami give Eyüpsultan files two distinct characters.

On the new settlement side the disputes arise from housing projects: late delivery, defective workmanship, promises about common areas not kept, and arguments over site management. The brochure and show flat presented during the sale can count as annexes to the contract and should be kept.

On the older side, urban regeneration, shared title and condominium files come to the fore. In the areas neighbouring the historic peninsula, conservation law comes into play: alterations and rebuilding within a protected site require the permission of the conservation board, and unauthorised work gives rise to an obligation to restore the original state.

What both sides have in common is that the zoning certificate and the annotations on the title were not examined before purchase; a significant proportion of the files could have been prevented by that single step.

A practical note: When buying off plan, the buyer’s strongest protection until the title is transferred is having the promise-of-sale contract executed before a notary and annotated on the title. An ordinary written contract gives the buyer no right of ownership if the property is sold to a third party.

Which courthouse will your case be heard in?

Disputes within the boundaries of Eyüpsultan are heard at the Istanbul Courthouse (Çağlayan). This site, the central courthouse for the European side, has civil courts of first instance, commercial, family, labour, civil courts of peace, intellectual and industrial property, criminal courts of first instance and serious crime courts, together with the enforcement offices. Because the intellectual and industrial property courts sit here, this courthouse is the single address for trade mark and design disputes on the European side.

Administrative disputes are heard at a separate site, in the Istanbul administrative and tax courts.
