How does the meeting work?

So that travelling time is not spent unnecessarily, we usually hold the first meeting with clients in Sancaktepe by video. Permit and zoning disputes where development is rapid

The rapid development along the Sarıgazi, Samandıra and Yenidoğan corridor feeds Sancaktepe files from two directions: construction contracts in exchange for flats on the private law side, and permit and demolition acts on the administrative law side.

After a stop-work notice is drawn up, time is given to remedy the departure from the permit; if it is not remedied, a demolition order and a zoning fine follow. An action to annul those acts must be brought in the administrative court within sixty days of service. Bringing the action is not enough on its own: unless a stay of execution is requested in the first pleading, the building can be demolished before the case ends and the annulment left without practical effect.

On the private law side the landowner’s strongest protection is annotating the contract on the title. Without it, if the contractor sells on the shares it has taken, the landowner may be left with a claim in damages alone.

A practical note: A stop-work notice can be treated as served by being posted on the building itself. That means time can start to run without the owner knowing. Checking the municipal records regularly for a property under construction prevents the period from expiring quietly.

Which courthouse will your case be heard in?

Disputes within the boundaries of Sancaktepe are heard at the Istanbul Anatolian Courthouse (Kartal), the central courthouse for the Anatolian side. It houses the civil courts of first instance, commercial, family, labour, civil courts of peace, enforcement, criminal courts of first instance and serious crime courts together with the public prosecutor’s office; the enforcement offices are on the same site. As it is one of the busiest courthouses in Turkey, the intervals between hearings can be longer than elsewhere.

Administrative disputes (demolition, permits, tax, personnel matters) are not heard there but in the Istanbul administrative and tax courts.
