What is Informed Consent?
The consent given by a patient after being told, in comprehensible terms, of the nature, risks and alternatives of the medical procedure to be performed.
Standard forms in general terms are not enough on their own; the burden of proving that the risks specific to the patient were explained lies with the physician. A defect in consent can give rise to liability even where what occurred was a complication.
