What is Participation Claim?

On liquidation of the matrimonial property regime, the claim each spouse has to half of the other’s residual value.

This is not a right in rem but a claim for money; the title is not divided automatically. The residual value is what remains of the acquired property after debts are deducted. Valuation is made on the market value at the time of liquidation, not at the time of purchase.
