What is Suspension of the Pronouncement of Judgment?

Known in short as HAGB. It applies to prison sentences of two years or less or judicial fines, provided the accused has no previous conviction for an intentional offence, the court is satisfied that they will not reoffend and the loss has been made good (payment in monthly instalments during supervision is also possible). For decisions given on or after 1 June 2024 the accused’s acceptance is not required and the decision may be appealed (istinaf); the institution was re-enacted by Law No. 7589 (31 July 2026). If the five-year supervision period (three years for those under 18 at the time of the offence) passes without a further intentional offence and with the obligations complied with, the case is dismissed; otherwise the judgment is pronounced.
