Minimum Legal Fee Tariff 2025-2026: Main Amounts and the Istanbul Bar Association’s Recommended Fee Schedule

Fixed amounts by court and type of work, proportional fee brackets, the two amendments in 2026, and the Istanbul Bar Association’s non-binding 2026 recommended schedule, under the tariff published in the Official Gazette of 4 November 2025.

In short: The Minimum Legal Fee Tariff sets the lower limit of the fee that may be agreed between lawyer and client and the attorney’s fee that the court will order the other party to pay. In this article we summarise the main amounts of the tariff that entered into force on 4 November 2025, the proportional brackets, the 2026 amendments and the Istanbul Bar Association’s recommended schedule.

The Minimum Legal Fee Tariff (Avukatlık Asgari Ücret Tarifesi, AAÜT) is the tariff, prepared each year by the Union of Turkish Bar Associations and published in the Official Gazette, that shows the lowest amounts of legal fees. The tariff in force was published in the Official Gazette of 4 November 2025, No. 33067 and entered into force on the same day. The amounts in this article belong to the tariff in force as of 8 October 2026. Since under Article 168 of the Attorneyship Law the tariff is prepared anew each year, the tables below will become outdated once the new tariff is published in the Official Gazette.

What is the tariff for? #

  • Lower limit of the contractual fee: An attorney’s fee below the tariff cannot be agreed (Attorneyship Law Art. 164; AAÜT Art. 1/3). The parties may freely agree on a fee above the tariff.
  • Attorney’s fee charged to the other party: The fee that the court orders the other party to pay in favour of the lawyer of the winning party cannot be less than the amount in the tariff or more than three times that amount (AAÜT Art. 3). This fee is separate from the fee the client has agreed with their own lawyer.
  • Which year’s tariff? In assessing the fee, the tariff in force on the date the legal assistance is completed or the judgment is given at the end of the case is taken as the basis (Attorneyship Law Art. 168).

Since family courts are established at the level of courts of first instance under Article 2 of Law No. 4787, the amount provided for courts of first instance applies in divorce, maintenance and custody cases. The tariff also provides a separate fixed amount of 40.000,00 TL for partition and division cases.

Matters whose subject is money: proportional fee brackets #

If the subject of the case or proceedings is money or can be valued in money, the fee is calculated according to the brackets in the third part of the tariff; however, it cannot fall below the fixed amount provided for the court hearing the case (AAÜT Art. 13).

There is a special rule for enforcement proceedings: in proceedings with an amount of up to 56.250 TL, the fee is the fixed amount of 9.000 TL and cannot exceed the principal receivable; if the debtor pays within the payment period, three quarters of the fee determined is awarded (AAÜT Art. 11).

Amendments made in 2026 #

  • Official Gazette of 8 January 2026, No. 33131: Art. 10/2, which limited the fee to be awarded to the other party’s lawyer in case of partial dismissal in non-pecuniary damages cases, was repealed.
  • Official Gazette of 28 March 2026, No. 33207: Art. 14/5 on the fee in applications to criminal judgeships of peace such as right of reply, content removal and objection to an administrative fine was redrafted; if the administrative fine is below the fixed fee, a fee equal to the amount of the fine is awarded.

The fixed amounts and proportional brackets above are not affected by these amendments.

Separately from the AAÜT, bar associations may publish recommended schedules for their members. The Istanbul Bar Association’s 2026 schedule was adopted by decision No. 115/19 of the Bar Board of Directors dated 08.12.2025 and covers the period 01.01.2026–31.12.2026. This schedule is not binding; the attorney’s fee to be awarded by the court and the statutory lower limit of the contractual fee are the AAÜT amounts above. Some items from the schedule:

Costs not included in the tariff #

The amounts in the tariff are the consideration for legal services; court fees, cost advances, expert and service costs are paid separately. Statutory limits on fee agreements #

  • A percentage fee may be agreed, not exceeding twenty-five per cent of the value of the case or of the amount to be awarded (Attorneyship Law Art. 164/2).
  • If there is no written fee agreement or the fee is disputed, in matters whose value can be measured in money a fee of between ten and twenty per cent of the part of the case won is determined, not below the tariff (Attorneyship Law Art. 164/4).
  • In long-running files, stating clearly in the agreement which year’s tariff will be taken as the basis prevents disputes that may arise later.

What is the lowest legal fee in the tariff for a divorce case in 2026?
Since family courts are at the level of courts of first instance, under the tariff that entered into force on 4 November 2025 the amount for courts of first instance, 45.000 TL, applies to a divorce case. This amount is the lower limit of the fee that may be agreed in a contract; court fees and costs are not included. The Istanbul Bar Association’s non-binding 2026 recommended schedule lists 108.750 TL for an uncontested divorce and 188.500 TL for a contested divorce.
When is the minimum legal fee tariff renewed?
Under Article 168 of the Attorneyship Law, bar associations send their proposals to the Union of Turkish Bar Associations in September, the Union forwards the tariff to the Ministry of Justice by the end of October, and the approved tariff is published in the Official Gazette. The tariff in force was published on 4 November 2025. In assessing the fee, the tariff in force on the date the judgment is given or the work is completed is taken as the basis.
Is the Istanbul Bar Association’s fee schedule binding?
No. The Istanbul Bar Association’s 2026 schedule is a recommendation. The statutory lower limit is the Minimum Legal Fee Tariff published in the Official Gazette; the attorney’s fee that the court orders the other party to pay is also determined according to this tariff.
If I win the case, does the other party pay my legal fee?
The court awards an attorney’s fee under the tariff in favour of the lawyer of the winning party and orders the other party to pay it. This fee cannot be less than the amount in the tariff or more than three times that amount, and it belongs to the lawyer. The fee the client has agreed in a contract with their own lawyer is separate and cannot be claimed from the other party.
