Three problems that recur in student lettings

The concentration of rental housing around the university campus shifts the weight of Avcılar files towards tenancy law. Three subjects recur in the enquiries we receive from the Denizköşkler, Cihangir and Üniversite neighbourhoods.

The deposit not being returned. The landlord may deduct from the deposit only damage that is proved and unpaid debts; wear arising from ordinary use cannot be charged to the tenant. A photographic inventory taken at the start and end of the tenancy largely settles the argument.

Several tenants signing. Where all the flatmates are parties to the contract, joint and several liability arises as a rule: if one does not pay the rent, the landlord may claim the whole from the others. A tenant who leaves does not automatically cease to be liable unless a replacement tenant is added in writing.

Using a student flat as a business. Using the premises for a purpose other than that stated in the contract gives the landlord a right to terminate after notice.

A practical note: In student lettings the contract is often made in a parent’s name, with the student not named as tenant. In that case the parent is the party to the contract, so eviction and debt claims are brought against them. Who the party is depends on the party details at the head of the contract.

Which courthouse will your case be heard in?

Disputes within the boundaries of Avcılar are heard at the Küçükçekmece Courthouse. That courthouse has civil courts of first instance, family, labour, civil courts of peace and criminal courts of first instance, together with the enforcement offices. It is close to our office in Bakırköy along the E-5 and the Metrobüs line; hearings and enforcement steps can be planned for the same day.

Serious crime files belong to the serious crime centre to which the district is attached, and administrative disputes to the Istanbul administrative and tax courts.
